Marketplace Terms & Disclaimer
1. Our role
BirkinBagStock provides a discovery surface for individual owners to list their authenticated Birkins. We charge a flat listing fee for placement and a manual review of the submission. We are a publisher and review service, not a marketplace operator, broker, or escrow provider.
2. Seller obligations
- You confirm the Birkin is in your physical possession at the time of listing.
- You confirm you are legally entitled to sell it (no liens, no joint ownership disputes, no theft).
- You confirm the bag is genuine to the best of your knowledge.
- You accept full responsibility for the accuracy of your listing details (size, color, leather, hardware, year, condition, included accessories).
- You agree we may reject your listing if our reviewer flags inconsistencies, suspected counterfeit signals, or insufficient photo/video evidence.
3. Buyer obligations
- You acknowledge AI verification signals are a first-line check and not a guarantee of authenticity.
- Before payment, use professional authentication (Entrupy, Real Authentication, Bababebi) or buy in person.
- You contact the seller directly. Do not pay BirkinBagStock or send funds via a link or method not initiated by the seller.
- If the bag arrives different from the listing, you resolve the dispute with the seller (or via your payment provider's protection).
4. Fees and refunds
Listing fees ($49 Standard, $99 Featured) are charged at submission and cover 60 days of placement plus manual review. If a listing is rejected for material misrepresentation we may, at our discretion, refund the fee. We do not refund listings that are rejected for poor photos or unclear video; we ask the seller to resubmit better evidence (fee remains valid 30 days).
5. AI verification signals
We may run automated visual analysis on photos and video frames using a large vision model (currently Google Gemini Vision). The output flags: blind stamp legibility, date-code format, "HERMÈS PARIS MADE IN FRANCE" hardware engraving consistency, saddle-stitch pattern, color/leather consistency with claim, and common counterfeit indicators. A numerical signals score is shown to buyers. The score is informational only and is not a determination of authenticity.
6. Counterfeits, suspensions, and bans
If a listing is reported by a buyer or flagged by our reviewer as a likely counterfeit, we will remove the listing immediately and notify the seller. Repeat offenders may be banned from future listings and reported to relevant consumer-protection authorities. We may retain submission records (photos, video, IP, payment metadata) for fraud investigation.
7. Data we keep
For each listing: seller name, email, optional WhatsApp/Instagram handle, country, listing details, submitted media URLs, IP address, PayPal order id, and review history. We retain this for at least 24 months for fraud and dispute purposes. We do not share contact details with buyers until the buyer clicks "Show seller contact" on the listing page.
8. Prohibited listings
- Bags not in the seller's possession (no drop-shipping, no listing on behalf of another party without authorization).
- Bags currently consigned with another reseller or marketplace.
- Bags subject to active disputes, returns, or chargebacks at another platform.
- Bags with hardware, blind-stamp, or stitching signals consistent with super-fake production lots.
- Listings priced below 40% of the comparable used-market median (often signals fraud).
9. No warranty
The marketplace is provided "as is." To the maximum extent permitted by law, BirkinBagStock disclaims all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement. Our maximum aggregate liability to any seller is capped at the listing fee paid; to any buyer it is zero, as BirkinBagStock is not a party to any sale.
10. Governing law
These terms are governed by the laws of the United Arab Emirates (where the publishing entity is incorporated). Disputes will be resolved in the courts of the UAE, except where local consumer law mandates otherwise.
